How To Enter: Beginning 08/16/09 at 12:00:01 AM (Pacific Time) and continuing through 09/15/09 at 11:59:59 PM (Pacific), go to http://beautybymark.com/sweepstakes.aspx, and follow the on-screen instructions to register as a customer. This submits your entry into the current sweepstakes to Heather Wulff (“Sponsor”).

Prize Recipient Selection: One (1) potential prize recipient for each prize will be selected in a random drawing from among all eligible Sweepstakes entries received by Sponsor during the Sweepstakes Period. Heather Wulff, whose decisions on all Sweepstakes-related matters shall be final, binding and non-appealable in all respects, will conduct random drawing. Odds of being selected to receive a Sweepstakes prize (the “Prize”) will depend upon the total number of eligible Sweepstakes entries that Sponsor receives during the Sweepstakes Period.

ENTRIES: Limit (1) one Sweepstakes entry per household for the THE "Get Ready for Fall" SWEEPSTAKES. Multiple entries from the same household will be disqualified. Entries using macro, robotic, script or other forms of automatic entry will be disqualified from the Sweepstakes and will become ineligible to receive any prize hereunder. Entries become the exclusive property of the Sponsor and will be neither acknowledged nor returned. No mechanically reproduced Sweepstakes entries are permitted. Proof of submission does not constitute proof of receipt by Sponsor. If there is a dispute as to the identity of an on-line entrant, the Prize will be awarded to the authorized account holder of the e-mail address. The “authorized account holder” is defined as the natural person to whom the e-mail address is assigned by an Internet service provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
ELIGIBILITY: This Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia. All BeautyByMark.com customers eligible to win. Avon and mark. reps and employees not eligible to enter and win.
CONDITIONS OF PARTICIPATION: Each entrant into the Sweepstakes must have a valid e-mail address, and it is each such entrant’s responsibility to update Sponsor (in writing) of any change in his/her e-mail address. Expenses not specifically included in the Prize description (or in the description of any Prize component[s]), and all applicable federal, national, state, provincial and local taxes and surcharges, are the sole and full responsibility of the actual Prize recipient. Each Prize component is awarded “as is”, with no warranty or guarantee, either express or implied, outside of any particular manufacturer's limited warranty. No transfer, assignment, substitution or cash redemption of any prize hereunder is permitted, except that Sponsor specifically reserves the right to substitute the Prize or any particular Prize component(s) for an item(s) of equal or greater value in the event that one or more of the above-set forth Prize components becomes unavailable. This Sweepstakes shall be governed by all applicable federal, national, state, provincial and local laws and regulations. Each entrant into the Sweepstakes hereby agrees to be bound by each of the terms of these Official Rules and by each of the decisions of Sponsor, which decisions are final, binding and non-appealable on all matters pertaining to this Sweepstakes. The potential Prize recipient (and his/her parent or legal guardian if such potential Prize recipient is a minor) may be required to sign and return an Affidavit of Eligibility, a Liability Release and, where legally permissible, a Publicity Release, all within seven (7) days following the date of first attempted notification of such Prize recipient. Failure to comply with this deadline shall result in forfeiture of the Prize and selection of an alternate potential Prize recipient by means of a subsequent random drawing to be conducted from among all other eligible Sweepstakes entries received by Sponsor during the Sweepstakes Period. Return of the Prize/any Prize component/prize notification as undeliverable shall result in forfeiture of the Prize and selection of an alternate potential Prize recipient by means of a subsequent random drawing to be conducted from among all other eligible Sweepstakes entries received by Sponsor during the Sweepstakes Period. Any potential Prize recipient hereby further agrees that he/she will sign any documents deemed necessary or desired (as determined and supplied by Sponsor in its sole discretion) in order to transfer copyright of his/her Sweepstakes entry exclusively and irrevocably to Sponsor within seven (7) days following the date of first attempted notification of such Prize recipient. Acceptance, possession or use of the Prize (or any Prize component) constitutes explicit and irrevocable permission for Sponsor and its agencies and designees to use the actual Prize recipient’s name and/or likeness (photographic or stimulated), biographical material and/or Sweepstakes entry submission/materials (including an altered form of the entry) for any and all advertising, marketing, promotional and other legitimate business purposes without the payment to such actual Prize recipient of any additional compensation of any kind or amount, unless expressly prohibited by law. By participating in this Sweepstakes each Sweepstakes entrant hereby agrees to indemnify and hold harmless, and by accepting, possessing or using the Prize (or any Prize component) the Prize recipient hereby agrees to indemnify and hold harmless, Sponsor, its advertising, marketing and promotion agencies, all prize suppliers hereunder, and their respective parent companies, subsidiaries, affiliates, partners, representative agents, successors, assignees, officers, directors, and employees (collectively, the “Sweepstakes Entities”), from and against any and all claims, actions, causes of action, demands, judgments, liability, injuries, damages, losses, costs and expenses (including, without limitation, attorneys’ fees and damage to any computer equipment/software) arising out of, resulting from or relating to, directly or indirectly, in whole or in part, his/her participation in this Sweepstakes or the acceptance, possession, use or misuse of any prize hereunder. INTERNET: None of the Sweepstakes Entities is responsible for electronic transmission errors resulting in omission, interruption, deletion, defect or delay in operations or any transmission, theft or destruction or unauthorized access to or alterations of any Sweepstakes entry submission/materials, or for any technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof. If for any reason the Internet portion of the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause(s) which may corrupt or affect the administration, security, fairness, integrity, safety or proper conduct of this Sweepstakes, then Sponsor hereby specifically reserves the right, exercisable at any time in its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes. In such event, Sponsor hereby specifically reserves the right to select the potential Prize recipient by means of a random drawing to be conducted from among those eligible Sweepstakes entries received by Sponsor as of the termination date. The Sweepstakes Entities hereby further reserve the right to disqualify from participation in this Sweepstakes and from receipt of any prize or prize components(s) hereunder any individual who tampers with the entry process. The Sweepstakes Entities may prohibit any entrant from participating in this Sweepstakes if they determine that such entrant is attempting to undermine the legitimate operation of this Sweepstakes by cheating, hacking, deception or any other unfair playing practices or by intending to abuse, threaten or harass any other Sweepstakes entrant(s). DISPUTES/CHOICE OF LAW: Except where expressly prohibited by applicable law or regulation, each entrant into this Sweepstakes hereby agrees that: (a) any and all disputes, claims, actions, causes of action and demands arising out of or connected with this Sweepstakes, or any prize awarded (or potentially to be awarded) hereunder, shall be brought/filed and adjudicated/resolved individually, without resort to any form of class action, and exclusively by the state or federal courts situated in San Diego, Ca (with each entrant into the Sweepstakes hereby agreeing irrevocably to submit to the exclusive personal and subject matter jurisdiction and causes of action, demands, judgments, liability, damages and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (c) no punitive, exemplary, indirect, incidental, special, consequential or other damages, including without limitation lost profits, may be awarded (collectively, "Special Damages"); and (d) each entrant into the Sweepstakes hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California State law (without reference to California State’s choice of law rules) and the federal laws of the United States of America shall govern this Sweepstakes and all aspects related thereto.
